This opening session will establish the statutory and jurisdictional framework that governs Landlord and Tenant Board proceedings, including the scope of the Boards authority, statutory exemptions, monetary jurisdiction, and the interaction between the LTB and the courts.

This session expands on the foundations by addressing the purpose, structure, and strategic use, of common landlord-initiated Application processes under the Residential Tenancies Act, 2006, including detailed analysis of the L1 and L2 application processes. This session is designed to strengthen practical understanding of how statutory rights are activated and exercised through proper application selection and sequencing.

This session moves beyond the mechanical and into the strategic core of eviction litigation by examining rent-related termination under sections 58 and 59, then transitions into the conduct-based issues — substantial interference (s. 64), damage (ss. 62–63), illegal acts (s. 61), interference with landlord enjoyment (s. 65), and overcrowding (s. 67).

The session shifts the focus away from rent arrears and into a more nuanced and often misunderstood area of residential tenancy litigation; the structure of lawful rent itself.  As will be explored, rent disputes are rarely about arithmetic.  Rent disputes are about entitlement.

This session turns to one of the most frequently litigated — and often misunderstood — areas of residential tenancy law: maintenance obligations and cleanliness responsibilities under the Residential Tenancies Act, 2006. This talk begins by examining the landlord maintenance duty under section 20 and touch on the tenant cleanliness obligation under section 33, exploring how these statutory duties operate in real disputes before the LTB.

This session continues examining the legal framework governing maintenance and cleanliness obligations within rental units and residential complexes, including how standards of “ordinary cleanliness” are interpreted in practice, how tenant conduct may trigger enforcement mechanisms, and how evidentiary considerations shape outcomes before the LTB.

This session builds directly upon the discussion from last week about evidentiary foundation and now moves into advocacy execution — how evidence is actually deployed, tested, challenged, and ultimately used to persuade. The focus will be on the practical mechanics of advocacy before the LTB, including structured witness examination, strategic use of objections, disciplined use of expert evidence, and the formulation of clear and effective closing submissions.

May 6, 2026

This session shifts the focus from advocacy at a hearing to strategic dispute resolution including when and how to settle effectively. Participants will develop an understanding of how to evaluate the risks and benefits of settlement versus proceeding to hearing, how to engage in purposeful negotiation within the LTB framework, and how to use mediation and consent orders to achieve efficient and enforceable outcomes.

This session will examine common pitfalls and failure points that frequently undermine otherwise sound resolutions, such as incomplete issue coverage, misalignment with the underlying Notice or Application, and drafting ambiguity that invites future disputes.
